process to prove non-infringement. They were the deeper chilling of the raw
material, the use of a different, critical solvent, and the use of two vessels
versus one as described in the patent.

Defendant chemical manufacturing company was accused of infringing plaintiff’s process for producing an intermediate chemical used in the production of a drug for treatment of HIV. At issue was defendant’s improvement of the process originally patented by defendant, and whether those improvements were outside the scope of the invention.
