In a complex bifurcated matter, plaintiff inkjet cartridge manufacturer sought patent infringement in the first part and defended antitrust anti-competitive allegations in the second. At issue in the patent infringement action was defendant’s reuse of expended parts of plaintiff’s various models of patented inkjet cartridges to create a new product that would accommodate multiple refills using inks formulated almost identically to plaintiff’s patented products. Therefore, infringement related to two entirely different technologies: the cartridge itself and ink chemistry.
