A professional ophthalmic trade organization was accused of colluding with disposable contact lens manufacturers to restrain discount mail order resellers from obtaining products from manufacturers and then selling them direct to consumers without the involvement of treating optometrists. The defense contended that there was no proof of any conspiracy and that the organization’s position reflected valid health care concerns promoted by its membership.
