Plaintiff owned and operated a major workers compensation insurance company that was frequently at odds with the State Insurance Commission. After several years of frustration on both sides, the State seized the company from plaintiff after alleging that its cash reserves were unacceptably low.

Plaintiff alleged that the seizure was retribution for continual and serious criticisms of the Commission and he sought the return of his company and compensation for the seizure.
