Weld Shop Modification of Suspension Caused Fatal Accident

This 3D-illustration set the stage by illustrating the original factory
suspension and the proper separation distance of the rear axle and the
shock absorber. Color-coding helps differentiate the component parts.

A fatal head-on collision in the Central Valley of California left two prominent businessmen dead after a car driven by the defendant in the oncoming lane abruptly swerved in front of them. The cause of the crash was attributed to the sudden engagement of the left side parking brake of the oncoming car. This was caused by a sudden rupture of the left rear shock absorber that had been rubbing against the rear axle after a modification of its mounting bracket during an after-market lift kit installation. Who was to blame? The driver or the weld shop that modified the position of the bracket on the axle?
